1. Copyright

Moral rights include the right to publicize, the right to indicate one's name, and the right to maintain identity, and the copyright property includes the right to reproduce, public performance, public transmission, exhibition, distribution, rental, and creation of secondary works.

If a department store purchases a commercially available record and plays it in the department store, how is it treated under copyright law?: It is an infringement of the performance right under the Copyright Act. However, copyright property rights are restricted in cases where the performance is not paid in return by the audience or spectators, but performances in department stores or large marts are an exception. Therefore, this act is an infringement of the public performance right, so you must obtain permission from the copyright holder.

1) Types of author's property rights

- Reproduction right: The right to temporarily/permanently fix or reproduce a tangible object through printing, photography, sound recording, copying, video recording or other means

- Public performance right: Performance or performance of a work or performance, phonogram, or broadcast , singing, oral performance, reading, screening, reproduction, or other means to be disclosed to the public

- Public transmission rights: Covering all forms of use to transmit copyrighted works to the public, such as wireless/cable/broadcasting and on-demand The right to have exclusive control

- The right to display: The right to display the work on the outer wall or other open place so that passers-by can see it

- Distribution right: The original or its copy of the work, etc. The right to transfer or lend without receiving

- Rental right: The right to rent a commercial record or commercial program for profit

- The right to create a derivative work: The right of an author to create and use a derivative work based on his/her work as the original work

 

2) Assignment, exercise, and extinction of author's property rights

- Author's property rights are a bundle of rights, so they can be separated and transferred separately

- Permission to use copyrighted works: Copyright holders allow others to use their copyrighted works while retaining their own copyrighted property rights (bond)

- In the event that the author dies without an heir, or the legal entity or organization that holds the author's property right is dissolved, the author's property right shall be extinguished.
