1. Significance and Role of Patent Specification
1) Significance of Patent Specification: It refers to a statement that clearly and specifically describes the technical content of the invention, and is required to achieve the two purposes of use by a third party and protection of the inventor. In general, a patent specification consists of a title of the invention, a brief description of the drawings, a detailed description of the invention, and claims.
2) Role of patent specification: A patent specification specifies the subject of patent examination and trial and performs both the role of a book of rights specifying the applicant's rights, and a role of a description that discloses the technology to third parties in detail.
2. Structure and description method of patent specification
1) Structure of patent specification: Patent specification includes the name of the invention that can express the invention simply and clearly, and the technical field to which the invention belongs, the technology behind the invention, and the description of the invention. It consists of the problem to be solved as the content, the means of solving the problem, the effect of the invention, a brief description of the drawings, a detailed description for the implementation of the invention, the claims and the abstract, and the drawings.
In the case of the detailed description of the invention, it should be described clearly and in detail so that a person skilled in the art, that is, an average person of ordinary skill in the field can easily carry out the invention. The content to be included in the description as a specific method of explanation is the technical field (it is better to write it as broadly as possible), the prior art (it becomes the standard for judging the inventive step and novelty), the problem to be solved, the effect of the invention, a brief description of the drawings, and it includes specific descriptions for practicing the invention.
2) Claims: This is one of the most important parts of the specification as it sets the scope of protection of the patent right at the time of patent registration. The claims should be supported by the detailed description of the invention, the invention should be described concisely and clearly, there should not be content that does not correspond to the detailed description, and the detailed description and terms should be used in a unified manner.
