Let's continue the discussion on “Introduction to Intellectual Property and Understanding Intellectual Property”. Among them, today we will look at “Other Trademark Issues”.
1. Domain Name (URL)
A domain name is in the form of a trademark mark, so it can be registered as a trademark without receiving special treatment during registration examination. The mere possession of a domain name similar to a registered trademark does not constitute trademark infringement. When similar or identical goods and services are sold through similar or identical domain name, this is an act of unfair competition and is defined as trademark infringement.
2. Parallel Import of Genuine Products
Parallel import refers to importing goods into Korea without going through an official channel. In order to discuss the legality of parallel imports, the authenticity of imported goods must be premised. In other words, in order to be permitted as parallel import, 1) foreign and domestic trademark holders must have attached the trademark to the imported goods, and 2) foreign trademark holders and domestic trademark holders are in the same or close relationship, so that the attached trademark is a domestic registered trademark.
Today we learned about “Other Trademark Issues”. Next, we will discuss the “application and examination process for designs”.
